A historical analysis of the criminalisation of juveniles

Abstract

The study presents the legal history of the criminalisation of juveniles from the Csemegi Code to the present day. The author begins by examining the current terminological issues surrounding the criminalisation of the age group under investigation. In the analysis of the objective and subjective conditions of criminality, substantive legal issues come to the fore, but in order to shed light on the causal relationships, it is also essential to deal with the topic across legal branches and scientific fields. After presenting current concepts, the author examines the legal-historical roots of the dogmatic system of juvenile delinquency. With the analysis from a historical perspective that runs through the study, we wanted to point out that in the course of legislative decisions that respond to social issues, it is worth focussing on previous good practices in the context of historical retrospection and bringing these into the present with the necessary changes.
