Abstract

This study presents the examination of the phenomenon of violence in legal and state theory, within the context of post-Cold War geopolitical conflicts and the challenges of globalization. It reviews the philosophical history of violence from George Sorel to Hannah Arendt, highlighting the shortcomings of classical legal theory in fully exploring the connections between violence and law. It thoroughly discusses Rudolf Jhering's and Max Weber's concepts of state and legal theory, emphasizing the state's monopoly on coercion and legitimate violence. The article pays special attention to Walter Benjamin's "Critique of Violence," presenting the dialectic of law-creating and law-preserving violence, as well as Benjamin's messianic aspiration to abolish violence and achieve a non-violent social state..
