Abstract

This study examines the position of referendums as a tool of direct democracy within the Hungarian public law system, with a particular focus on the role of electoral committees. It thoroughly discusses the procedural and substantive legal aspects of referendums, the conduct of national and local initiatives, as well as the authentication of questions and available legal remedies. It emphasizes the function of electoral committees as independent bodies subject exclusively to law, their duties in ensuring the fairness and legality of elections, and the sanctions they can impose. The author compares Hungarian practices with referendum procedures in other European countries and addresses excluded topics, such as budgetary or personnel matters. The analysis also covers changes introduced by the new electoral procedure act (Act XXXVI of 2013) and the National Election Committee's jurisdiction over media service providers.
