This article is excerpted from a chapter of the author’s master’s thesis submitted to the Europa-Institut of Saarland University on 12 December 2012 in completion of her LL.M. studies in European law. In 2013, the master’s thesis was awarded the ‘Hans-Werner-Osthoff-Preis’ of the Prof.-Dr.-Osthoff Foundation as the best master’s thesis of the academic year 2012/2013.
