Barna Horvtáh's synoptic legal theory

Abstract

In our study, we present the synoptic perspective associated with Horváth Barna through his theory of power. In his work Sociology of Law, he examines the interaction between power and law through the history, sociology, logic and politics of power, which two, according to him, are not located on two different levels, but should be understood as a synoptic concept. While in law we compare the normative legal principle with the actual legal case, in power we consider the behavior of others together with our own behavior or freedom. We also examine the relationship between power and freedom, as well as their possible intersections. From the comparison of the performance of the two and the synoptic reference to each other, we conclude the sociological law that justice is embodied in socially possible freedom.
